The Indian Gaming Regulatory Act and Arizona Casinos
Tuesday, May 18th, 2010The casinos are not new and can be found almost anywhere you take your trip in the United States. The state of Arizona is no different. If you live in Arizona or have traveled there, is likely to be passed through one or more casinos increasingly popular in the Desert Southwest.
A study conducted by NAU (Northern Arizona University) confirmed the popularity through an extensive research project. Wanted NAU game and when the study was completed and the results were very clear. The report indicates that one third of all of Arizona, said he had also played in a casino in Arizona.
In 1988, the United States was that Congress passed a bill that later became known as the Law on Indian Gaming Regulatory, also known as IGRA. Igra has long recognized the popular form of entertainment in the game and used it as a means to promote the economic development of many Indian tribes.
There are many people who honestly believe that casinos are the answer to Native Americans to become self-sufficient in order to be able to promote their own tribal government money through the benefits of these casinos, Arizona.
AIGA organization members represent about 19 tribes, representing 90 percent of American Indians living on reservations in Arizona SATE. This organization was created to help both protect and promote the welfare of Native American tribes of India. His focus has been and still is, is to help its members strive to be self-sufficient.
The organization is in their belief that they are definitely committed to preserve and protect both the sovereign authority of the Government of India. The IGRA regulatory act allows any state that operate gambling on Indian reservations if the state allows games such as off the reservation.
The law was IGRA following a Supreme Court decision that basically says that states have no influence on the game at any U.S. reservation tribe.
Before this law, the 1987 decision of the Supreme Court of California against the Cabazon Band of Mission Indians, in fact means that the states have no regulatory authority in regard to Indian reservation casinos.
The Indian Gaming Regulatory Act of 1988 allowed the states and Indian tribes to be able to regulate tribal Class III gaming, including games like blackjack, slots, keno and other casino related games.
During the 1990s, there were many tribes of Arizona, who have installed slot machines in their casinos, although none of them had Tribal-State compact with the state game. At that time, the Arizona Governor Symington believes that Native American reservations should not be allowed to have casinos, because at that time, Arizona does not allow gambling, which was considered outside the reservation.
The tribes of Arizona had argued that already permit gambling, allowing gambling acts as the horse and dog racing, bingo games in the charity, and state lotteries that were available immediately.
The National Indian Gaming enacted legislation to clarify these standards in 1992, which says that a tribe must have a gaming compact with a state before being allowed to operate slot machines within its territory.
Following this decision, the governor of Arizona called on the United States Attorney in Phoenix, Arizona, to proceed to close every casino had slot machines. It was like something you would see in a movie. FBI agents raided several gambling casinos in India and seized their gaming machines.
In Fort McDowell Casino near Scottsdale, Arizona, many members of the tribe of Native Americans tried to prevent these agents withdraw their slot machines to form a block that caused a deadlock for three weeks.
A year later, in 1993, the Governor signed an agreement with Native American tribes that allowed Indian tribes have these slot machine game in each of its reserves.
Not included in this agreement were board games compact. In 2003, however, the popular game of blackjack has been added to the list of games that have been allowed.
